Welcome to Artbusters. These Terms & Conditions (“Terms”) govern your access to and use of the Artbusters website, as well as purchases of artwork and related products or services through the website.
Throughout these Terms, “Artbusters,” “we,” “us,” and “our” refer to Artbusters LLC, a North Carolina limited liability company. “You” and “your” refer to any visitor, customer, purchaser, or other user of our website.
By accessing or using our website, placing an order, or requesting or purchasing a custom art commission, you agree to these Terms. If you do not agree with these Terms, please do not use the website or purchase through it.
1Eligibility and Use of the Website
You may browse the Artbusters website regardless of age, subject to applicable law.
To make a purchase or enter into an agreement for commissioned artwork, you must be at least 18 years old or otherwise have the legal capacity to enter into a binding contract. If you are under 18, purchases should be made by or with the involvement and authorization of a parent or legal guardian.
You agree to use this website only for lawful purposes and in accordance with these Terms.
You may not use the website in a manner that could damage, disable, interfere with, or compromise the website, its security, Artbusters, or other users.
2Artwork and Product Information
We make reasonable efforts to accurately describe and display artwork offered through Artbusters, including its dimensions, materials, medium, colors, and other relevant characteristics.
However, original and handmade artwork is inherently unique. Variations in texture, brushwork, surface, color, finish, pattern, and other characteristics are part of the nature of original artwork and should not necessarily be considered defects.
Colors and appearance may also vary depending on photography, lighting conditions, computer monitors, mobile devices, display settings, and other factors. We therefore cannot guarantee that the artwork you receive will appear exactly as it does on your screen.
Dimensions listed on the website are intended to be reasonably accurate but minor variations may occur, particularly with handmade or custom pieces.
Unless specifically stated otherwise, frames, display accessories, furniture, props, room settings, or other decorative items appearing in photographs or visual mockups are not included with the artwork.
Please review the individual artwork description before purchasing.
3Availability
Many artworks sold by Artbusters are original, one-of-a-kind pieces and may therefore be available in only one quantity.
Placing an item in your shopping cart does not necessarily reserve the artwork.
Although we make reasonable efforts to keep availability information current, an artwork may occasionally become unavailable before our website is updated.
If you purchase an artwork that is no longer available, we will notify you and issue an appropriate refund for the unavailable item.
4Orders and Acceptance
Submitting an order does not necessarily constitute final acceptance of that order by Artbusters.
We reserve the right to accept, decline, or cancel an order where reasonably necessary, including in cases involving:
- Incorrect pricing or product information
- Artwork that is no longer available
- Suspected fraudulent or unauthorized transactions
- Payment processing problems
- Shipping or delivery limitations
- Website or technical errors
If we cancel an order after payment has been successfully received, the amount paid for the canceled item or order will be refunded using the appropriate payment method or payment processor.
5Pricing
Prices are displayed in the currency indicated on the website.
We reserve the right to change artwork prices at any time before an order is completed.
Unless expressly stated otherwise, listed artwork prices may not include shipping charges, applicable taxes, customs duties, import charges, or other fees that may apply to a particular transaction or destination.
The total amount presented during checkout will reflect the charges calculated by the website or applicable checkout provider at that time.
In the event of an obvious pricing, typographical, or technical error, Artbusters reserves the right to correct the error and cancel or decline the affected transaction. If payment has already been received for an order that is canceled because of such an error, an appropriate refund will be issued.
6Payments
Artbusters currently uses PayPal to process online payments.
Payment information submitted through PayPal is processed by PayPal in accordance with PayPal's applicable terms, policies, and privacy practices.
Artbusters does not receive or store your complete credit or debit card number or your PayPal login credentials.
An order may be subject to payment authorization and verification before it is accepted or fulfilled.

7Shipping and Delivery
Shipping availability, processing times, estimated delivery times, shipping charges, tracking, delivery issues, and related requirements are described in our Shipping & Delivery Policy.
Delivery dates and transit times are estimates unless expressly guaranteed in writing. Delays caused by shipping carriers, weather, customs, incorrect addresses, transportation disruptions, or circumstances outside our reasonable control may occur.
Customers are responsible for providing complete and accurate shipping information.
Our Shipping & Delivery Policy forms part of these Terms.
8Returns, Refunds and Cancellations
Eligibility for returns, refunds, exchanges, and order cancellations is governed by our Returns, Refunds & Cancellation Policy.
Because original artwork, custom artwork, and personalized artwork have different characteristics, different return and cancellation rules may apply to each category.
Please review the applicable policy before completing your purchase.

9Custom and Commissioned Artwork
Requests for custom, personalized, or commissioned artwork may be subject to additional terms concerning matters such as:
- Deposits and payments
- Customer-provided reference materials
- Artistic interpretation and discretion
- Dimensions and materials
- Revisions and approvals
- Production timelines
- Changes requested after work begins
- Cancellations
- Final approval
- Shipping and delivery
- Copyright and reproduction rights
These matters are addressed in our Custom Art & Commission Terms and, where applicable, any written quotation, invoice, commission agreement, email confirmation, or other agreement between Artbusters and the customer.
If specific written terms for a commission conflict with general provisions in these Terms, the specific written terms agreed upon for that commission will control with respect to that commission.
10Intellectual Property
Unless otherwise stated, the Artbusters website and its content—including artwork images, photographs, graphics, logos, designs, text, descriptions, layouts, branding, and other original content—are owned by Artbusters, the applicable artist, or the respective rights holder and are protected by applicable intellectual property laws.
Website content may be viewed for personal, non-commercial purposes.
Unless you have received prior written permission from the applicable rights holder, you may not copy, reproduce, modify, distribute, publish, sell, license, commercially exploit, create unauthorized derivative works from, or otherwise use protected Artbusters content or artwork images beyond what is permitted by applicable law.
11Purchase of Artwork and Copyright
Purchasing an original physical artwork transfers ownership of that physical artwork to the purchaser after full payment, but does not automatically transfer copyright or other intellectual property rights in the artwork.
Unless expressly agreed otherwise in writing, the applicable artist or copyright owner retains all copyright and reproduction rights in the artwork.
Accordingly, purchasing an artwork does not by itself give the purchaser the right to reproduce, manufacture, commercially print, license, distribute, create merchandise from, or otherwise commercially exploit the image or design of the artwork.
Any transfer or license of copyright or reproduction rights must be expressly agreed to in writing by the applicable rights holder.
12Use of Artwork Images
Artwork displayed on the Artbusters website may not be reproduced or commercially used without permission from the applicable rights holder.
This includes, without limitation, using artwork images for commercial prints, posters, apparel, merchandise, advertisements, digital products, NFTs, promotional materials, or other commercial purposes.
Nothing in these Terms prevents uses that are expressly permitted by applicable law.
13Customer-Provided Materials
If you provide photographs, images, designs, text, logos, or other materials to Artbusters in connection with a custom commission or other request, you represent that you have the rights, licenses, permissions, or authorization reasonably necessary for Artbusters to use those materials for the requested purpose.
You agree not to knowingly provide materials that infringe another person's copyright, trademark, privacy, publicity, or other legal rights.

14Prohibited Conduct
You agree not to:
- Use the website for unlawful or fraudulent purposes
- Attempt to gain unauthorized access to the website or related systems
- Introduce malware, viruses, or other harmful technology
- Interfere with website operation or security
- Scrape, harvest, or systematically extract website content without authorization where prohibited by law
- Impersonate another person or misrepresent your identity
- Use Artbusters content in violation of intellectual property rights
- Use the website in a way that infringes the legal rights of Artbusters, an artist, another customer, or another person
We reserve the right to restrict access to the website where reasonably necessary to protect Artbusters, our customers, artists, website systems, or legal rights.
15Third-Party Services and Links
The Artbusters website may contain links to or integrations with third-party websites and services, including payment processors, social media platforms, shipping providers, and other services.
These third parties operate independently and may have their own terms, privacy policies, and practices.
Artbusters is not responsible for the content, availability, privacy practices, security, or operation of third-party websites or services except to the extent responsibility cannot legally be excluded.
16Website Availability and Accuracy
We make reasonable efforts to maintain the website and provide accurate information.
However, we do not guarantee that the website will always be uninterrupted, error-free, secure, or available, or that all website information will always be complete or free from typographical or technical errors.
We may modify, suspend, update, or discontinue portions of the website when reasonably necessary.
17Disclaimer of Warranties
To the extent permitted by applicable law, the Artbusters website and its content are provided on an “as is” and “as available” basis.
Nothing in these Terms excludes warranties, guarantees, or consumer rights that cannot lawfully be excluded or limited.
The unique characteristics and normal variations inherent in handmade and original artwork are not necessarily defects.
18Limitation of Liability
To the fullest extent permitted by applicable law, Artbusters will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of, or inability to use, the website or from matters outside Artbusters' reasonable control.
Nothing in these Terms limits or excludes liability that cannot legally be limited or excluded under applicable law.
Your rights relating to damaged, lost, incorrect, or otherwise eligible orders are also subject to our applicable Shipping & Delivery and Returns, Refunds & Cancellation policies.
19Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold Artbusters harmless from claims, damages, liabilities, or reasonable expenses arising from your unlawful use of the website, your material violation of these Terms, or materials you provide to Artbusters that infringe the rights of another person.
This provision does not apply to the extent a claim or loss was caused by Artbusters or where indemnification is prohibited by applicable law.
20Governing Law
These Terms & Conditions and any dispute arising out of or relating to your use of the Artbusters website, purchase of artwork, or other transaction with Artbusters will be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict-of-law principles.
Nothing in these Terms is intended to limit or waive any consumer protection rights or other rights that cannot be waived under applicable law.
21Changes to These Terms
We may update these Terms periodically to reflect changes to our website, artwork offerings, business practices, policies, or applicable requirements.
Updated Terms will be posted on the website with a revised “Last Updated” date.
Changes will apply prospectively unless otherwise required or permitted by applicable law.
22Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
23Entire Agreement
These Terms, together with our Privacy Policy, Shipping & Delivery Policy, Returns, Refunds & Cancellation Policy, Custom Art & Commission Terms, and any additional terms expressly agreed to for a particular transaction, constitute the applicable agreement between you and Artbusters concerning your use of the website and purchases from Artbusters.
